Kota Kinabalu: A 42-year-old man was charged in the Magistrate’s Court here with assaulting his wife.
Chin Chee Hung pleaded not guilty before Magistrate Wan Farrah Farriza Wan Ghazali to voluntarily causing hurt to his wife , 38, by punching her at about 10pm on Sept 9, at a house in Taman Bintang, Luyang, here.
The offence is framed under Section 323 of the Penal Code read with Section 326A of the Penal Code.
Section 323 carries a maximum jail term of one year, or a fine of up to RM2,000, or both, while Section 326A provides for imprisonment of up to twice the maximum term for voluntarily causing hurt to a spouse or certain family members.
The court fixed Nov 11 for pre-trial case management and released Chin on RM2,600 bail in two sureties.
In another case, a 43-year-old man was sentenced to three months’ jail for theft.
Rudy Hamzah pleaded guilty to stealing a bag belonging to one Yakarias Irawan containing, among other things, a laptop, hard disk, nine pendrives, chargers, a power bank, some documents, stamps, clothing and personal belongings, on Aug 24, at 11.15am, at a hotel in Jalan Pantai.
The charge is framed under Section 380 of the Penal Code, which carries a maximum 10 years’ jail and a fine on conviction.
The court heard from the prosecution that at about 10.23am on the said day, the complainant had checked out of the hotel after leaving a black backpack beside a chair near the reception counter while he went to an ATM to obtain money to settle his outstanding bill.
Upon returning, the complainant found that the bag was missing.
CCTV footage showed an unidentified man taking the bag containing the said items with total losses estimated at RM6,500 and leaving the hotel.
Police then arrested Rudy at a premises in Karamunsing Complex, on Aug 26, in connection with the case.
