Charged with raping daughter: Security guard fails to get bail

Kota Kinabalu: A security guard, who was charged with two counts of raping his daughter, failed in his attempt to apply for bail on Tuesday.

Sessions Court Judge Elsie Primus rejected the 42-year-old man’s application to get bail after he failed to give a reasonable excuse to the court when his case was brought up for bail application.

During the proceedings, the man asked for bail to be granted to him saying that he has many dependents outside as well as debts that he needed to settle.

He informed the court that none of his family members were present in court on Tuesday.

The court set Jan 10, 2023 for pre-trial-case management and ordered the man to be remanded further pending the date.

Earlier, the court has granted application by counsel Mohd Ari Nadzrah Abd Rahman to discharge himself from representing the man following the instruction from the man’s family who did not wish for the counsel to represent the man.

On the first count, the man is accused of raping the 16-year-old girl in a living room of a house in Kota Marudu at 1am on Sept 2 this year.

On the second count, he allegedly raped the same alleged victim at the same place at midnight on Sept 8.

The offence under Section 376(3) of the Penal Code provides for a jail term of between eight and 30 years, and whipping at least ten strokes, on conviction.

Deputy Public Prosecutor Mas Izzaty Lokman appeared for the prosecution while the man was not represented.
