
Kota Kinabalu: An unemployed man claimed trial in the Sessions Court here to cheating a man of RM165,000 over the purported sale of a parasailing boat.
Jasmin Andy pleaded not guilty before Judge Zaini Fishir @ Fisal to cheating one Alijin Darman into believing that he was acting as a middleman in the sale of a parasailing boat and dishonestly inducing the complainant to hand over RM165,000.
The alleged offence was committed at the office of Brulun Travel and Tours Sdn Bhd at Aeropod here at about 8pm on April 20 this year.
The charge under Section 420 of the Penal Code carries a jail term of between one and 10 years, whipping, and is also liable to a fine, on conviction.
Deputy Public Prosecutor Fazriel Fardiansyah applied for pre-trial case management and objected to bail, submitting that the accused is a non-citizen holding only an IMM13 document and posed a flight risk.
He further submitted that the complainant suffered losses amounting to RM165,000 and that the accused had been unemployed prior to his arrest, adding that there were no special circumstances to justify granting bail.
Counsel Lim Ming Zoong @ Lawrence, representing Jasmin, applied for bail.
The court fixed July 21 for case management, denied bail and ordered the accused to be further remanded.
