Kota Kinabalu: A 32-year-old man was charged with four counts of committing sexual physical harassment against his two daughters.
The man who appeared before two Sessions Court judges to face the charges pleaded not guilty to all counts.
On the first and second counts, the man entered his plea before Sessions Court Judge Amir Shah Amir Hassan.
Meanwhile, the third and fourth counts were heard before Sessions Court Judge Hurman Hussain. The charges stated that the man had allegedly committed the offences against his daughters age 13 and 12, by touching their private parts and breasts, respectively.
The alleged incidents took place at 4pm at a unit condominium, here on Dec 26, 2025.
The offence under Section 14 (a) of the Sexual Offences Against Children Act (SOACA) 2017 carries a jail term of up 20 years and whipping, upon conviction.
Due to the relationship between the man and the alleged victims, an additional punishment applies under Section 16 of SOACA, which provides for a jail term of up to five years and at least two strokes of whipping.
Both judges set June 16 for mention and no bail was offered to the man following an objection by the prosecution.
In Amir’s court, Deputy Public Prosecutor (DPP) Bryan Francis submitted that there was a high possibility the man would tamper with the prosecution’s witnesses.
The man applied for bail, telling the court that he has seven children and wished to see his youngest child.
Meanwhile, DPP Fazriel Fardiansyah Abdul Kadir also objected to bail, stating that the man is the biological father of the victims and that, at the time of the alleged incident, they were living in the same house.
The man told Hurman that his children are currently living in different houses.
