Outgoing Chief Justice Tun Tengku Maimun Tuan Mat recently underscored the vital role of courage and steadfastness in judicial leadership, urging leaders within the judiciary to remain resolute in upholding justice.

Speaking at a program titled "Live to Lead: The Chief Justice’s Journey" held at Universiti Malaya, she stressed that the judiciary serves as both the foundation for progress and a benchmark by which the public assesses the nation and its community. “As a leader of the judiciary, one must always remember that the judiciary is the gateway to progress,” she remarked.

Tengku Maimun highlighted the importance of translating the principle of judicial independence into action. “It’s very easy to talk about judicial independence, but that principle must be reflected in your actions and judgments,” she said. She added that judicial leaders must exhibit the bravery to make decisions based on what they believe is right, regardless of external pressures.

When addressing allegations and criticisms she has faced as Malaysia’s first female chief justice, Tengku Maimun clarified that these challenges were not related to her gender. Instead, they often stemmed from misunderstandings about her position and the decisions she made in her capacity as chief justice.

Reflecting on her judicial career, she singled out the landmark case of kindergarten teacher M. Indira Gandhi as particularly significant. The case revolved around a civil law dispute stemming from the marriage of Indira, a Hindu, and her ex-husband K. Pathmanathan, who had converted to Islam and adopted the name Muhammad Riduan Abdullah. Tengku Maimun emphasized that the case was adjudicated strictly under civil law principles.

“When you contract a civil marriage, any issues arising from it must be resolved in the civil court. That’s a clear principle, and there’s no room for debate on that,” she stated. Despite facing criticism for allegedly not protecting Islam, Tengku Maimun maintained that the case had no bearing on Islamic principles.

Tengku Maimun’s tenure as Malaysia’s chief justice is set to conclude in July 2025, when she reaches the mandatory retirement age of 66. However, her service could be extended by an additional six months, as permitted by law.

As she prepares to step down, Tengku Maimun’s legacy will be remembered for her unwavering commitment to justice and judicial independence. Her emphasis on courage, fairness, and adherence to the rule of law serves as a guiding principle for future judicial leaders.
