A 24-YEAR-OLD childcare worker has pleaded not guilty in the Sessions Court to a charge of failing to provide adequate supervision and care, resulting in the death of a baby under her care at a daycare centre in Wangsa Maju, three months ago.
Nor Fatihah Abdul Rahim entered her plea before Judge Siti Shakirah Mohtarudin after the charge was read during proceedings earlier today.
Deputy Public Prosecutor Nidzuwan Abd Latip prosecuted the case under Section 33(1)(a) of the Child Act 2001, which carries a penalty of up to RM20,000 in fines, up to five years’ imprisonment, or both, upon conviction.
According to the charge, Nor Fatihah, in her capacity as a caregiver, allegedly failed to make adequate preparations for the reasonable supervision and care of seven-month-old Muammar Aidil, resulting in his death. The incident reportedly occurred at approximately 11.08am on 26 May at a daycare facility in Wangsa Maju.
The court granted bail at RM20,000 with one surety, alongside several conditions requested by the prosecution. These include reporting to the police once a month, surrendering her passport, and refraining from contacting prosecution witnesses.
The case has been fixed for mention on 29 September.
Media reports from May stated that police had received a report concerning the death of a seven-month-old baby boy at a childcare centre in Taman Danau Kota, Setapak.
Deputy Wangsa Maju District Police Chief, Superintendent Syahrul Anuar Abdul Wahab, confirmed that a post-mortem found the baby had died from milk aspiration.
He added that the case was initially investigated under Section 31(1) of the Child Act 2001. - August 22, 2025
