Kota Kinabalu: A company was fined RM20,300 by the Magistrate's Court here after pleading guilty to continuing to fail to comply with an award issued by the Malaysian Consumer Claims Tribunal (TTPM).
Sabah Domestic Trade and Cost of Living Ministry (KPDN) Sabah director Shahril Nizam Shahidin said Alex Contractor Sdn Bhd admitted an offence under Section 117(2) of the Consumer Protection Act 1999 for continuing to disregard a tribunal award dated April 21, 2025, which ordered the company to pay RM50,000 to a claimant.
He said Magistrate Marilyn Kelvin imposed the fine, with six weeks' imprisonment in default of payment, adding that the company has since settled the fine but remains legally required to pay the RM50,000 tribunal award, failing which KPDN will initiate further legal action.
Shahril said the prosecution, conducted by prosecuting officer Gunasegaran Krishnan, followed the company's earlier conviction under Section 117(1) of the same Act on Dec 2, 2025, for failing to comply with the same tribunal award, with the latest penalty reflecting 203 days of continued non-compliance.
He said Sabah KPDN viewed non-compliance with tribunal awards seriously as it undermined consumer rights and the integrity of the consumer claims system, and urged consumers to lodge complaints through KPDN's WhatsApp line, e-Aduan portal, call centre or the Ez Adu KPDN mobile application.
