Cook jailed for assaulting ex-girlfriend

Kota Kinabalu: A 34-year-old restaurant cook was jailed four months, Thursday, for assaulting his former girlfriend early this month.

Alfharit Wahab pleaded guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to Siti Nasuah at 11.30pm on April 6, in a unit at Bandar Sierra Apartment, near here.

The charge under Section 323 of the Penal Code carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.

Inspector Kelvan Elson Maik in tendering the facts of the case, told the court that Siti’s housemate lodged a police report stating that prior to the incident, she heard a harsh knock on the door and heard the door being opened loudly.

Read more The complainant went out of her bedroom and saw Siti lying in pain and being beaten by a man, later identified as Alfharit.

Police investigations revealed that before the incident, the victim was having supper with her male friend in the living room and that Alfharit had hit, kicked and stepped on Siti and also injured her male friend.

The complainant called the security guard to resolve the situation but Alfharit was still not satisfied and refused to leave the house and even threatened to kill Siti if the complainant was not there.

The complainant’s neighbour managed to calm Alfharit, the court heard.

Kelvan said further investigations revealed that the incident occurred because Alfharit could not accept that his relationship with the victim had ended and was not satisfied that the victim had a new acquaintance.

The victim who suffered from swelling in the head and bruises in the arms and legs received treatment at the hospital.

Unrepresented, Alfharit begged for a lenient sentence because he was worried about his mother who lives in Tawau as he always sends money to her.

He added that he did not have money to pay the fine.

The prosecution applied for an adequate sentence.

In another case, six men were jailed after they admitted separately to having syabu.

Security guard Ismaili Ismail, 25, was jailed a year from Thursday for having 0.44gm of syabu on Jan 20, 2022 at Api-Api Centre.

He was handed another 10 months jail for having another 0.13gm of syabu on April 2, 2022 also at Api-Api Centre and ordered to serve the sentence consecutively with the first count.

On the third and fourth count, Ismaili was jailed six months each for taking syabu on April 2, 2022 and Jan 20 the same year.

The other men Ahmad Awang and Azril Ajwadi were each handed 10 months jail for having syabu weighing 0.11gm and 0.13gm respectively on Feb 21 at Kg Sembulan Tengah and on Jan 7 at Inanam.

Mohd Hisam Tiar and Faridzu Izwan were jailed 10 months and seven months respectively for jointly having 0.03gm syabu on March 4 at Manggatal town while Chu Voon Kiong was sentenced to seven months jail and fined RM1,000 or four months jail for having 0.24gm of syabu at Feb 12 at Inanam.

The six were charged under Section 12 (2) of the Dangerous Drugs Act 1952, which provides for a fine of up to RM100,000 or up to five years jail or both, on conviction.
