Kota Kinabalu: A policeman was acquitted by the Magistrate’s Court, here, of assaulting a man three years ago.

Magistrate Wan Farrah Farriza Wan Ghazali acquitted and discharged Corporal Rizal Lee Abdullah, without his defence being called.

Wan Farrah held that the prosecution had failed to establish a prima facie case.

Rizal, 36, was alleged to have voluntarily caused hurt to Jumaidi Juna at 8.15pm on Oct 6, 2022, at the Malaysia Airlines Bhd (MAB) staff parking lot at Kota Kinabalu International Airport (KKIA).

On June 30, 2023 Lee claimed trial to the charge under Section 323 of the Penal Code which provides for a jail term of up to one year or a fine or both, on conviction.

The prosecution had called five witnesses to testify in the trial. Deputy Public Prosecutor Bryan Francis prosecuted.

Rizal was represented by counsel Amli Nohin.

In another case, a 26-year-old woman was jailed six months and fined RM2,500, or three months in jail, for dishonestly misusing her employer’s petty cash.

Shamira Shanti pleaded guilty before Magistrate Marilyn Kelvin to dishonestly using for her own benefit RM4,692.12 belonging to P&C Services Development Sdn Bhd, at the company’s premises in Kolombong, on Oct 1, this year.

The offence, under Section 403 of the Penal Code, carries a jail term of up to five years, whipping and a fine, upon conviction.

The court was informed by Prosecuting Officer Inspector Yusdi Basri that an accounts manager at the company discovered during a review of the September accounts that the petty cash balance of RM4,692.12 for the Inanam and Kolombong branches was missing.

Upon checking, the money was found not to be in the custody of Shamira, who had been entrusted with it.

An internal investigation revealed that Shamira had taken the money for her own use without the company’s knowledge.

The company then lodged a police report, leading to her arrest, said the prosecution.
