
A HUSBAND and wife were brought before the Sessions Court in Kuala Lumpur today to face two charges of misappropriating RM56,000 in company funds, allegedly used to pay the rent for their private residence while disguising it as office rental.
Nor Atiqah Mohamad Alwi, 36, and her husband Muhamad Fakhrullah Abd Rahim, 37, both pleaded not guilty after the charges were read before Judge Mohd Azhar Othman.
At the time of the offence, Nor Atiqah was a director of A2 Wax Sdn Bhd.
The couple is accused of dishonestly withdrawing RM49,000 and RM7,000 from the company’s account on 29 August and 23 November 2021, as well as 31 January 2022, purportedly to cover the rent of the company’s office premises in Puchong, Selangor.
The prosecution claims, however, that the premises were in fact their personal residence.
They are charged under Section 403 of the Penal Code, read together with Section 34, which carries a penalty of six months to five years’ imprisonment, whipping, and a fine upon conviction.
Both were granted bail of RM8,000 each with one surety.
The court also ordered them to surrender their passports, report monthly to the nearest Malaysian Anti-Corruption Commission (MACC) office, and refrain from contacting prosecution witnesses.
The case is set for mention again on 4 November.
Prosecution was led by Deputy Public Prosecutor Rabiatul Addawiah Mohd Noorlee and MACC Prosecuting Officer Nur Raihan Mohd Yusof. The accused couple was represented by counsel Abdul Rahman Ab Razak.
In a separate case before the same court, former Assistant Community Development Officer Muhammad Maududi Abd Rashid, 36, was fined RM6,000 after pleading guilty to three charges of accepting bribes totalling RM2,100 in exchange for registering a care centre owned by a woman who also chaired a non-governmental organisation and directed a company.
The offences, under Section 165 of the Penal Code, were committed at a bank in Jertih between July and September 2023.
Judge Mohd Azhar imposed a RM2,000 fine for each offence, with a default of two months’ imprisonment if payment is not made. He remarked that such misconduct, if left unchecked, could become “a cancer” in society.
