
The Court of Appeal has unanimously overturned the corruption conviction and sentence against Muar MP Syed Saddiq Syed Abdul Rahman, marking a significant turn in the high-profile case involving the former youth minister.
The panel, comprising Justices Datuk Ahmad Zaidi Ibrahim, Datuk Azman Abdullah, and Datuk Noorin Badaruddin, concluded that the trial judge had committed serious errors in the initial ruling. Delivering the decision, Justice Noorin stated that the High Court failed to consider key aspects of evidence and legal procedures, particularly concerning Syed Saddiq's instructions to withdraw funds from the youth wing of Bersatu, known as Armada.
According to the panel, there was no dishonest intent in his directive to remove money from the account, and the actions taken were in line with his legal authority over the funds. The judges highlighted that the High Court had relied on testimonies obtained under pressure from the Malaysian Anti-Corruption Commission (MACC), without properly weighing the context or credibility of such statements.
The appellate court further noted that the trial ruling neglected to consider procedural inconsistencies and failed to provide a comprehensive analysis of the defence’s arguments. The judgment emphasized that a serious lapse occurred in the trial court’s decision-making process, which ultimately led to a misdirection in law.
With the Court of Appeal finding that the prosecution’s case lacked sufficient weight and that the defence was not adequately considered, the conviction and sentencing were formally nullified.
During the verdict delivery, Syed Saddiq appeared composed, occasionally nodding and jotting down notes. At one point, he was seen visibly emotional, wiping away tears. Supporters and family members, including public figure Bella Astillah, were present in the courtroom.
This outcome brings an end to the legal battle Syed Saddiq has faced since being charged, clearing his name of the four corruption-related offences previously linked to party funds. The Court of Appeal’s ruling effectively restores his standing as a parliamentarian and former minister, while raising concerns about the judicial process that led to his initial conviction.
