
The High Court ruled that the seven-year jail sentence and two strokes of the rotan imposed on Muar MP Syed Saddiq Syed Abdul Rahman for criminal breach of trust (CBT), dishonest misappropriation of property, and money laundering were neither excessive nor unwarranted. Justice Azhar Abdul Hamid highlighted the importance of holding public figures to higher standards, particularly those viewed as role models for the younger generation.
In his written judgment, the judge emphasized that Syed Saddiq’s position as a prominent political figure played a significant role in determining the punishment. Additionally, a fine of RM10 million was imposed on the former youth chief of Bersatu, further underscoring the gravity of his offenses.
The court acknowledged that this was Syed Saddiq’s first criminal conviction, noting that he still has time to reflect on his actions and learn from his mistakes. However, the seriousness of the crimes, which involved the misuse of public trust and significant funds, demanded an appropriately severe penalty.
The case revolved around charges brought against Syed Saddiq last year. On November 9, 2023, he was found guilty of CBT for withdrawing over RM1 million belonging to Bersatu Youth without proper authorization. He was also convicted of dishonest misappropriation of RM120,000 from the youth wing’s election fundraising efforts and two counts of money laundering involving RM100,000 transferred to his personal account from a company associated with Bersatu Youth, Armada Bumi Bersatu Enterprise (ABBE).
For the CBT charge, Syed Saddiq received a three-year sentence, while the misappropriation of funds resulted in a two-year sentence. Each money laundering offense carried a two-year jail term. Although the total sentence adds up to nine years, the court ruled that the terms would run concurrently, reducing the effective imprisonment period to five years.
The court rejected Syed Saddiq’s defense arguments, deeming them implausible. Justice Azhar found it unconvincing that Syed Saddiq, as Bersatu Youth's leader at the time, was unaware of the withdrawal of such a substantial sum of money. The evidence presented demonstrated that the withdrawal was unauthorized and executed under his direction. Additionally, the act of hiding the money at the youth wing’s office pointed to bad faith.
Regarding the RM120,000 misappropriation, which was raised during an election campaign, the court concluded that transferring the funds into his personal account was unjustifiable. Justice Azhar noted that payments could have been handled through ABBE’s account, making the transfer suspicious and indicative of personal gain.
Syed Saddiq’s defense that the funds were used to reimburse personal expenditures lacked evidence, further undermining his claims. The court found no merit in his assertion that he had no role in or knowledge of the financial misconduct.
The judge remarked that public figures, especially those in leadership roles, bear greater accountability. Syed Saddiq’s actions, the court ruled, betrayed the trust placed in him by both his party and the public.
The High Court’s ruling sends a strong message about the importance of integrity and accountability in public office. Syed Saddiq has appealed the sentence, and the Court of Appeal is scheduled to manage the case on January 16. Until then, the ruling stands as a significant moment in the fight against financial mismanagement and corruption in Malaysian politics.
