DUNGUN: A former student who sued her teachers over a disciplinary inspection during the 2020 SPM trial examinations has lost her case in the Sessions Court.
According to the New Straits Times, the student, who had been awarded one per cent in several subjects during the trial examinations, filed the lawsuit through her father seeking RM300,000 in damages for emotional trauma and RM100,000 for defamation.
In her claim, she alleged negligence, an improper body search and humiliation, stating that the inspection conducted in front of other students had damaged her reputation.
However, in written grounds of judgment dated March 5, Sessions Court judge Wan Nor Aklima Wan Salleh ruled that the teachers’ actions were reasonable and justified, noting that the student had admitted placing her mobile phone in her underwear during the examination.
The court also found that the inspection took place in a closed hall with only female teachers present and no inappropriate physical contact occurred, while the student has since filed an appeal against the Sessions Court decision to the High Court.
