
The Magistrates’ Court today documented the objection raised by the lawyer representing the mother of autistic boy Zayn Rayyan Abdul Matiin against the police's request to obtain her guilty plea in connection with his murder case.
Lawyer Fahmi Abd Moin, who represents the child's father, stated that Magistrate Zhafran Rahim Hamzah noted the objection to the police’s request made under Section 26(1) of the Evidence Act 1950. Fahmi argued that the request should have been made under Section 115 of the Criminal Procedure Code, a provision that has since been repealed. He emphasized that invoking Section 26(1) of the Evidence Act 1950 is inappropriate for securing a guilty plea before the magistrate. "There is no specific provision for making such a request, and it is highly prejudicial to the woman concerned," Fahmi told reporters outside the court.
The mother was present during the hour-long proceedings. When asked if the couple would be charged the following day, Fahmi indicated that this would be determined then.
Meanwhile, lawyer Mahmud Jumaat, who represents the child's mother, explained that during the closed-door session, his client did not enter a plea but instead provided testimony to the magistrate. "Even if a guilty plea is obtained during the investigation, it is not admissible during the trial unless it is recorded before a magistrate," Mahmud added.
The court complex saw media personnel gathering as early as 7:30 am to cover the latest developments in the remand case of the child’s parents. Strict security measures were in place at the entrance, allowing entry only to members of the public with official business.
The case dates back to December 6 of the previous year, when the body of 6-year-old Zayn Rayyan was discovered in a stream near his home at Idaman Damansara Damai Apartments after being reported missing a day earlier. His parents were subsequently arrested on May 31 in Puncak Alam, Selangor. Their 13-day remand period ends tomorrow.
