
Kota Kinabalu: A 27-year-old man, who was charged with having and planting a cannabis plant, was ordered to enter his defence.
Sessions Court Judge Elsie Primus on Thursday made the order after ruling that the court was satisfied that the prosecution had proved a prima facie case against Nicklen Jaccqres.
The court set July 17 for Nicklen’s defence.
Nicklen was accused of having and planting the 44.7cm cannabis tree that weighed 6.38gm at 2.40pm on Aug 19, 2020, in a room of a house at Kg Bahang, Penampang.

Six witnesses were called to testify during the prosecution’s stage.
Counsel PJ Perira, representing Nicklen informed the court that the defence would be calling the accused as the sole defence witness.

Meanwhile, an unemployed man was jailed a week by the Magistrate’s Court here for stealing a bottle of liquor worth RM57.90 from a supermarket.
Bensamir Bajad, 32, pleaded guilty before Magistrate Lovely Natasha Charles to stealing a bottle of Redbull Whiskey at Bataras Supermarket at Wawasan Plaza at 7.16pm on June 6.
He was charged under Section 380 of the Penal Code which carries a jail term of up to 10 years and liability of a fine or both, on conviction.
The court was informed by the prosecution that Bensamir, who acted suspiciously while in the supermarket, was seen taking the liquor bottle and stuffing it into his bag and walking out of the store without paying.
Bensamir was detained outside the premises.
He confessed to stealing the liquor as he had no source of income and wanted to sell the item for syabu.
In another case, a man was ordered to pay a fine of RM1,000 or two weeks’ jail for having illegal gambling paraphernalia.
Chong Vun Kian pleaded guilty to having five illegal lottery tickets at 5pm on May 13, this year at a premises at Beverly Hills Plaza, Penampang.
The under Section 9(1) of the Common Gaming House Act carries a jail term of up to six months, or fine of up to RM3,000, or both, on conviction.
The prosecution informed the court Chong was arrested by police during Ops Dadu. Inspector Kelvan Elson Maik prosecuted.
