Court maintains acquittal of civil servant

Kota Kinabalu: The High Court maintained the discharge and acquittal of a government servant for having an imitation pistol.

Judge Christopher Chin Soo Yin in delivering his ruling on Wednesday dismissed the appeal by the prosecution against Norshamezi Norisham’s acquittal and affirmed the Sessions Court’s decision that the defence had raised reasonable doubt on the prosecution’s case.

The prosecution was appealing against the Sessions Court’s decision to discharge and acquit Norshamezi, 35, of the charge after a full trial.

On Oct 26, 2022, Norshamezi, a National Anti-Drugs Agency (Nada) officer, was discharged and acquitted from the charge of having a Glock pistol with one empty cartridge in his possession at 9.15pm on April 1, 2020, at the Nada Keningau Office junction.

Eight prosecution witnesses and two defence witnesses were called to testify during the trial.

Deputy Public Prosecutor Afiq Agoes appeared for the prosecution while counsel Luke Ressa Balang represented Norshamezi.

Meanwhile, a salesman was fined RM1,000 or two months jail for engaging in an online gambling activity.

Muhd Alfian Jamil pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence at 11.40am on Jan 21, this year at Bandaran Berjaya.

He was charged under Section 7(2) of the Common Gaming House Act 1953 which provides for a fine of up to RM5,000 or a jail term of up to six months or both, on conviction.

Earlier, the court was informed by the prosecution that police arrested Alfian during Op Dadu.

The police also seized Alfian’s handphone which contained online slot gaming apps and RM120 cash. Inspector Kelvan Elson Maik prosecuted.
