
The High Court has overturned the conviction and six-month jail sentence of a technician, Chiok Wai Loong, regarding a controversial Facebook post concerning the "Allah" socks issue. Justice Ahmad Bache declared that the sessions court failed to adhere to proper procedures during Chiok's court proceeding on March 22, particularly in recording his guilty plea.
Upon reviewing the notes and recordings, Justice Ahmad noted that the sessions court did not ensure Chiok understood the charge and the consequences of pleading guilty. Instead, the judge merely confirmed that the charge and sentence were read to him. Justice Ahmad emphasized the complexity of the charge and the absence of legal representation for Chiok, questioning how a layperson could comprehend such a lengthy charge without proper guidance.
Consequently, Justice Ahmad ordered that Chiok be charged again at another sessions court, underscoring the importance of ensuring fair treatment for all accused individuals.
Chiok had previously pleaded guilty at the sessions court under Section 233(1)(a) of the Communications and Multimedia Act for his Facebook comments and was fined RM12,000, which he paid. However, Justice Ahmad, presiding over a revision application by Chiok's lawyers, deemed the entire process unjust to the accused.
Highlighting his duty to prevent a miscarriage of justice, Justice Ahmad stressed the importance of upholding the time-honored court practice to ensure fair trials for all defendants.
Chiok was represented by lawyer N Surendran, while deputy public prosecutor Kalmizah Salleh appeared for the prosecution.
The High Court's decision signifies a commitment to uphold the principles of justice and fairness in legal proceedings. It underscores the importance of ensuring that accused individuals fully understand the charges against them and the consequences of their pleas, especially in cases where they lack legal representation.
