A 52-year-old businessman was hit with a RM5,500 fine by the Magistrate’s Court after pleading guilty to two charges of causing injury to a 70-year-old man earlier this month on a road in Cheras.
A 52-year-old businessman has been handed a four-month prison sentence by the High Court, overturning a previous fine of RM5,500. The accused, Saiful Adli Yusof, previously pleaded guilty in the Magistrate’s Court to two charges of causing injury to a 70-year-old man during a road rage incident in Cheras earlier this month.

During the initial proceedings, Saiful requested a lighter fine, expressing remorse and promising not to repeat the offence. He cited a monthly income of RM2,000, which he uses to support his wife, four children, and his chronically ill mother-in-law.
He was charged under Section 323 of the Penal Code for voluntarily causing hurt, which carries a penalty of up to one year in jail, a fine of RM2,000, or both. He also faced a charge under Section 506 for criminal intimidation, punishable by up to two years in jail, a fine, or both.
However, in a recent update, Kosmo! reported that the High Court has now sentenced Saiful to four months’ imprisonment. The decision was handed down by Judge Datuk Aslam Zainuddin during a sentence review today (25 February).

“His actions were completely unjustifiable”
Saiful recounted the incident, explaining that he lost his temper after the collision caused his three-day-old baby to slip from his wife’s arms and fall inside the vehicle.
The judge, however, ruled that Saiful’s subsequent actions were completely unjustifiable and carried serious consequences.
“After considering all the evidence, the court invokes Section 323 of the Criminal Procedure Code to recall this case and sets aside the fine previously imposed by the Kajang Magistrate’s Court,” the judge added.

Deputy Public Prosecutor Shahrul Ekhsan Hasim also characterised the assault as “extremely cruel,” highlighting video footage that showed the victim being punched, pinned against a car door, and kicked three times.
“This country has laws. He [Saiful] acted like a road bully, driven by reckless anger. We urge the court to hand down a sentence that will serve as a lesson,” the prosecutor stated.
