Court postpones sentencing in remaining rape charges against father already jailed for 165 years

THE Tawau Sessions Court has postponed proceedings in a further set of rape charges involving a father who has already been sentenced to a total of 165 years’ imprisonment for offences committed against his two daughters.

The accused, a 53-year-old tuition teacher from Lahad Datu, is facing seven additional charges relating to the alleged rape of his eldest daughter, now 25, with the court adjourned after being informed that key medical reports relating to the victim had yet to be obtained.

Judge Ahmad Faizadh Yahaya fixed July 21 for mention of the case, pending completion of the outstanding medical documentation before sentencing can proceed.

On May 6, the accused had pleaded guilty to all seven charges, which were filed separately at the Tawau Sessions Court. The offences are alleged to have taken place at various hotels in the district between December last year and March 19 this year.

According to the charges, the offences fall under Section 376(3) of the Penal Code, which carries a mandatory minimum sentence of eight years’ imprisonment and a maximum of 30 years, along with not less than 10 strokes of the cane upon conviction.

The prosecution was conducted by Deputy Public Prosecutor Suhayl Aminin Sallehuddin, while the accused was unrepresented.

The latest proceedings follow earlier sentencing at the Lahad Datu Sessions Court on April 8, when the same man was handed a cumulative 165-year prison sentence after pleading guilty to 11 counts of rape involving both his daughters, aged 25 and 22.

At that hearing, Judge Suhailla Selag imposed 15 years’ imprisonment for each charge, ordered to run consecutively, in addition to 10 strokes of the cane for each offence. - June 23, 2026
