The Magistrate’s Court in Lahad Datu has scheduled June 27 for the re-mention of a case involving 13 vocational college students accused of murdering a 17-year-old male student. The students, aged between 16 and 19, are facing charges of murdering Mohammad Nazmie Aizzat Mohd Narul Azwan at the Lahad Datu Vocational College. The alleged incident took place between 9 PM on March 21 and 7:38 AM on March 22 in the dormitory rooms 7 Resak and 5 Belian.
The charges were brought under Section 302 of the Penal Code, which, in conjunction with Section 34 of the same law, stipulates severe penalties including the death sentence or imprisonment of up to 40 years, as well as a maximum of 12 strokes of the cane if convicted.
Given the involvement of underage offenders, the court proceedings were held privately before Magistrate Nur Asyraf Zolhani. Representing the prosecution was Deputy Public Prosecutor Ng Juhn Tao. Of the 13 students, seven were represented by a team of lawyers including Datuk Ram Singh, Kamarudin Mohmad Chinki, Chen Wen Jye, and Amirul Amin Rashid. Lawyer Abdul Gani Zelika represented one of the accused, while the remaining five students did not have legal representation.
Ram Singh informed the press that the chemistry and post-mortem reports related to the case were still pending, and the new court date was set to allow time for the completion and submission of these critical documents. Additionally, he mentioned plans to file a bail application for his seven clients at the Tawau High Court the following day.
The case arose after Mohammad Nazmie Aizzat was discovered deceased on March 22 in a college dormitory, with multiple injuries and bruises noted on his body. This tragic event led to the arrest and remand of the 13 vocational college students.
The situation has drawn significant attention due to the severity of the charges and the involvement of numerous young students. The pending chemistry and post-mortem reports are anticipated to play a crucial role in the case, providing essential evidence that could influence the direction of the trial. The upcoming court date on June 27 will likely see further developments as these documents are submitted and the bail application is considered.
As the legal process continues, the community and the families involved remain on edge, awaiting further information and the court's decisions. The case underscores the serious nature of juvenile crime and the complexities involved when underage individuals face such severe allegations.
