Court upholds MAB’s decision to dismiss employee caught playing takraw during MC

THE Kuala Lumpur Industrial Court upheld MAB Kargo Sdn Bhd's decision to dismiss a cargo officer who was caught playing sepak takraw and using machinery to cut trees while on protracted medical leave.

Court president, Zulhelmy Hasan, ruled that the claimant, Che Zamberi Che Ani, had abused his extended medical leave granted to him due to injuries he suffered in a road accident in May 2021.

The court found that the claimant breached the trust and confidence placed in him by abusing his prolonged medical leave.

Che Zamberi defended his actions, arguing that the dismissal was too harsh, and that this was the first time the company had alleged he committed misconduct.

Che Zamberi suffered serious injuries in the accident and was hospitalised and granted medical leave until Sept 21 that year. – March 13, 2025
