A state appeals court on Friday upheld former Hollywood power-player producer Harvey Weinstein's 2022 rape conviction while ordering him to be resentenced.

"The sentence is vacated and the matter is remanded for resentencing," the court docket stated. "In all other respects, the judgment is affirmed."

Weinstein was found guilty in December 2022 in California of three counts of sexual offences, including rape. In February 2023, he was sentenced to 16 years in prison.

Weinstein's spokesman Juda Engelmayer said Weinstein would continue to appeal the conviction as "significant legal issues deserve further consideration."

"We are disappointed by today's decision and respectfully disagree with the court's conclusions."

The decision came a day after prosecutors in New York decided Weinstein would not face a fourth trial there.

More than 100 women came forward with sexual assault and harassment allegations against Weinstein, which set off the viral #MeToo social media movement in 2017. Weinstein has been in jail or prison since 2020.
