Kota Kinabalu: A 43-year-old man who was charged with having 3.51gm of Mirtazapine (poison) claimed he needed the poison for energy booster.

Amar Makruf pleaded not guilty before Sessions Court Judge Marlina Ibrahim to the charge against him.

He is accused of having the poison at 11.21pm on May 18, 2025 at a car park on the fourth floor of Kompleks Asia City.

The offence, under Section 9(1) of the Poisons Act and punishable under Section 32(2) of the same Act,  carries a fine of up to RM10,000, or a jail term of up to four years, or both, on conviction.

The court set Feb 26 this year for pre-trial case management and Amar’s counsel was advised to apply for bail to the other Sessions Court judge who was supposed to hear the case.

Deputy Public Prosecutor Dk Afiqah Alya Ak Johari appeared for the prosecution while counsel Lim Chun Yuan defended Amar.
