Defaming judge: Sarawakian charged

Kota Kinabalu: A 49-year-old Sarawakian was charged at the Magistrate’s Court here Tuesday with defaming a High Court Judge here five years ago.

Shaffarizan Mohamad, who appeared before Magistrate Lovely Natasha Charles was accused of defaming Datuk Mairin Idang (then High Court judge) by recording and distributing a video knowing that the defamation would damage Mairin’s reputation.

Shaffarizan allegedly committed the offence at 3.30pm on July 9, 2018 at the High Court office, Jalan Kg Air 1, here.

The charge under Section 500 of the Penal Code carries a jail term of up to two years, or a fine or both, if convicted.

Shaffarizan pleaded not guilty to the charge.

Inspector Kelvan Elson Maik, prosecuting proposed bail at RM4,000 in two sureties.

Unemployed Shaffarizan, who was not represented, said he has no problem with the bail offered.

Lovely fixed March 7 for case management and released Shaffarizan on a bail of RM2,500 in one surety.

In another case, five men were fined a total of RM6,000 for committing criminal violence, two years ago.

Ramlan Maidin, Hisyam Ghazali, Jamiun Talib, Rajis Asin and Jamil Budun, pleaded guilty to committing the offence against one Suzley Izuddyin Shukor at 10am on Nov 18, 2021 at a house in Taman Ketiau, Putatan.

They were each ordered to pay a fine of RM1,200 or two months in jail.

They applied for a lower fine on the grounds that they were embarrassed and remorseful of the action.

The prosecution applied for an adequate sentence.

The five were jointly charged under Section 141(e) of the Penal Code which carries a jail term of up to six months or fine or both on conviction.
