A 34-year-old delivery rider has been sentenced to 45 years in prison and 42 strokes of the rotan after being convicted of repeatedly raping and sexually assaulting his 11-year-old stepdaughter. The Kuala Terengganu High Court upheld the Sessions Court’s decision, rejecting the man’s appeal earlier today.
The crimes took place between June and November 2021 at a home in Kuala Nerus, where the accused lived with his wife and her daughter. The victim, just a child at the time, suffered repeated abuse which later led to five criminal charges—four counts of rape and one count of sexual assault.
The court, presided over by Judge Datuk Hassan Abd Ghani, found the appeal lacked merit, affirming that the prosecution had proven the case beyond reasonable doubt. The original ruling, delivered by the Kuala Terengganu Sessions Court on February 29, imposed a heavy sentence in accordance with the seriousness of the offences.
For each of the four rape charges under Section 376(3) of the Penal Code, the accused was handed 15 years in jail and 10 strokes of the cane. For the charge of sexual assault under Section 377CA, he was sentenced to seven years’ imprisonment and two strokes.
The judge ordered that the sentences for the first three rape charges run consecutively, while the fourth rape charge and the sexual assault sentence will be served concurrently. This arrangement results in a total of 45 years’ imprisonment. The jail term officially starts from April 14, 2025, the date of the High Court decision.
The severity of the punishment reflects the court’s stance on crimes involving vulnerable victims, particularly children. The sentencing also aims to serve as a deterrent against sexual violence within family settings.
According to reports, the accused was visibly distressed upon hearing the decision. He was seen crying and even fainted in the courtroom as the sentence was read out.
This case highlights the ongoing need for vigilance in protecting children, especially from abuse within their own homes. Authorities continue to encourage the public to report any suspicions of abuse to ensure victims receive protection and justice.
