Desperate Mother Pleads for Action as Missing Child Sparks Legal Battle

A desperate Malaysian mother is urging authorities to locate her missing three-year-old daughter, allegedly taken by her biological father, R. Kannan, in violation of a court order. The child, subject to an ongoing custody application, was reportedly taken by Kannan in September, a matter still under consideration by the High Court at that time.

Court documents reveal that Thevitthra succeeded in obtaining a mandatory injunction on November 21, 2023, granting her full custody. High Court Judge Datuk Julie Lack ordered Kannan to return the child immediately, prohibiting any contact without Thevitthra's permission. The court also mandated the Royal Malaysia Police to locate Kannan and the Immigration Department to prevent the child's exit from Malaysia.

Despite the court's directives, Thevitthra has had no contact with her daughter since September 2023. Letters and court orders sent to the Selangor police chief and inspector-general of police have yielded no updates on the child's whereabouts. The Immigration Department discovered the child left for Singapore on November 5, preceding the court order. Distressed, Thevitthra filed police reports in both Malaysia and Singapore.

The situation is alarming, with Thevitthra expressing serious concerns about her daughter's safety. The Selangor police, when contacted, did not respond to inquiries. Thevitthra's former counsel, Datuk Seri James Chow Kok Leong, confirmed the police's ongoing efforts to locate Kannan but provided no updates.

There have been changes in legal representation on both sides, with Kannan's previous counsel discharging himself and a new solicitor appointed in December. Thevitthra has also changed her counsel. An online case management date of March 19 has been set for an appeal against the mandatory injunction order before the Court of Appeal's deputy registrar. Kannan is listed as the appellant, with Thevitthra as the respondent. The search for the missing child continues, leaving the distraught mother anxiously awaiting any news on her daughter's well-being.
