
THE Senate has formally approved the 2025 amendments to the National Film Development Corporation Malaysia Act (FINAS), introduced by Minister of Communications Datuk Fahmi Fadzil, marking a significant step in the regulation and development of the nation’s film and creative content industry.
The amendments are aimed at ensuring that the regulatory framework for the local film sector remains relevant, robust, and aligned with advances in technology and the evolving digital content landscape.
Structured around three main pillars — industry development, governance enhancement, and the strengthening of regulatory and enforcement functions — the amendments seek to establish a more professional, transparent, and competitive industry ecosystem.
At the same time, they reinforce FINAS’s role as both a regulatory authority and an enabler for industry growth.
Addressing public concerns, FINAS clarified that the amendments do not extend to the regulation of social media content.
Additionally, over-the-top (OTT) platforms and video-on-demand (VOD) services are currently exempt from licensing requirements.
FINAS emphasised that the purpose of the amendments is not to restrict creativity, but to protect the welfare of creative workers and ensure compliance with laws governing commercial film production.
Throughout the legislative process, more than 50 engagement sessions were conducted with industry associations, production companies, television stations, OTT platforms, higher education institutions, as well as relevant ministries and technical agencies.
This extensive consultation reflects the Government’s commitment to the MADANI approach, ensuring that the amendments address the real needs and challenges of the industry.
FINAS expressed confidence that the amended act will serve as a catalyst for the creation of a more sustainable, integrity-driven, and competitive national film ecosystem, supporting Malaysia’s broader creative economy ambitions.
