In a twist of legal irony, Tun Dr Mahathir Mohamad finds himself at the center of a judicial tangle once again, this time involving the Royal Commission of Inquiry (RCI) into Malaysia's handling of the Pulau Batu Puteh issue.

His lawyer has advised him to steer clear of the RCI if its chairman, Tun Md Raus Sharif, does not step down or recuse himself due to a conflict of interest stemming from past clashes between the two.

The crux of the matter lies in Raus' previous role as chief justice and his contentious appointment as an additional judge, which Dr Mahathir had challenged in court. Adding fuel to the legal fire is the fact that it was during Dr Mahathir's tenure as prime minister that Raus resigned as chief justice, further complicating their history.

Rafique Rashid, Dr Mahathir's lawyer, rightly argues that Raus' involvement in the RCI presents a clear conflict of interest, as the commission's mandate directly relates to decisions made during Dr Mahathir's premiership. The call for Raus to step down or recuse himself is not just a legal formality; it goes to the heart of ensuring fairness and impartiality in the RCI's proceedings.

The importance of this issue extends beyond the legal realm; it strikes at the heart of public trust in the RCI's findings.

A tainted process, marred by perceptions of bias, would not only fail to deliver justice but also erode public confidence in the commission's ability to uncover the truth.

As the RCI unfolds, it is imperative that all involved parties prioritize transparency and fairness. If Raus does not recuse himself or step down, it may be wise for Dr Mahathir to heed his lawyer's advice and distance himself from the proceedings to maintain the integrity of the inquiry.

Only through a fair and unbiased process can the RCI hope to fulfill its mandate and restore public trust in Malaysia's judicial system.
