Drink-driving: 4 jailed, fined RM40k

Kota Kinabalu: Four men were fined a total of RM40,000 and jailed one day each for drink-driving by the Traffic Court, Thursday.

Arthur Jason Joseph, 26, Joshua Ting Ek Hong, 22, Franco Anthony, 49, and Evan Baxter Aloysius, 34, pleaded guilty separately before Magistrate Marilyn Kelvin to committing the offence at separate locations in Penampang.

They were each fined RM10,000 or jailed nine months and a day’s jail.

Loo and Andrew committed the offence at Jalan Bundusan on Jan 18, last year at 12.20am and 12.10am respectively

Arthur drove his car while he was under the influence of alcohol at 1.30am on Nov 24, 2024 in front of SMK Bahang, Penampang, while Josua committed the offence along Pintas Kopungit at 12.25am last March 1.

Franco committed the offence at 9.13am on Sept 10, 2024 along Jalan Penampang Baru while Evan was driving under the influence of alcohol at 2.22am last Jan 16 in front of Plaza 333, Penampang.

The four requested leniency.

They were charged under Section 45A(1) of the Road Transport (Amendment) Act 2020 which provides for a jail term of up to two years and a fined between RM10,000 and RM30,000.

Traffic Prosecuting Officer, Inspector Khairul Nizam appeared for the prosecution.
