Drink-driving: Cook jailed and fined

TAWAU: A sixty-five-year-old cook, who drove under the influence of alcohol which resulted in an accident, was sentenced to one month’s jail and fined RM10,000 or three months’ jail.

Lim Shui Sang pleaded guilty before Magistrate Dayang Aidaku Amira Aminuddin to committing the offence at the intersection of Lorong Delima at around 7.30pm on July 21, 2024, when he was found with 167mg of alcohol in 100ml of blood, which was 117mg above the legal limit of 50mg.

On Aug 21, 2024, Lim was previously fined RM1,800 or five months’ jail after pleading guilty under Section 186 of the Penal Code for obstructing a public servant in the execution of his duties by refusing to cooperate with the police when they attempted to arrest him for investigation.

Read more On the same date, Lim was also fined RM1,700 or three months’ jail for committing traffic offence under Section 52 (1) of the Road Transport Act 1967 for failing to stop at the scene of the incident.

Based on the facts of the case, the accident occurred when the driver of a Perodua Bezza, 29, was heading towards Batu 2, Jalan Apas from Taman Semarak. As he approached Lorong Delima, a motorcycle ridden by the victim, 26, coming from the opposite direction, suddenly fell into the right lane after being hit from behind by Lim.

AdvertisementAs a result of the incident, the motorcyclist was injured, while Lim, who was driving a Toyota Unser MPV, immediately returned home to Taman Bintang before being arrested at his residence on the same day, even though he initially refused to cooperate with the police.

During mitigation, counsel Jhesseny P Kang, who represented Lim, requested a light sentence, citing his old age, health problems, and the need for regular medication and treatment.

AdvertisementMeanwhile, Traffic Prosecuting Officer ASP Joan Lee requested the court to impose an appropriate sentence as a lesson and a reminder to Lim, especially since Lim had already pleaded guilty to two other charges related to the accident.

She emphasised that in determining the sentence, only relevant factors should be considered, and the difficulties and hardships that Lim’s family might face if he were to be imprisoned were not related to the crime he committed.
