
Kota Kinabalu: Two people were jailed and fined a total of RM22,000 on Wednesday for drink driving, last year.
Fong Cheong Chiew, 41, and Lea Vanessa, 24, pleaded guilty separately before Magistrate Lovely Natasha Charles to committing the offence at 12.24am and 12.40am, respectively on Oct 22, 2021 at Jalan Bundusan, near the Shell kiosk, in Penampang.
They were each sentenced to one day jail and fined RM11,000 or three months jail.
The charge under Section 45A(1) of the Road Transport Act (Amended 2020), provides for a jail term of up to two years and fined between RM10,000 and RM30,000 and lose qualification from holding or getting a driving licence for not less than two years from the date of conviction.
Traffic prosecuting officer Inspector Mohd Firdaus Che Mustafa told the court that the two were found committing the offence during a roadblock.
The court also ordered both Fong and Lea to be disqualified from holding or obtaining a driving licence of not less than two years from the date of the conviction.
Meanwhile, a businessman was fined RM2,000 or two months jail on Wednesday for having an imitation gun.
Faizul Nazreen Yusof, 39, pleaded guilty before Magistrate Stephanie Sherron Abbie to having an imitation pistol at 5.20pm on June 20, this year in a bag in a vehicle in front of a house at Jalan NC Mogunting, Taman Wawasan Mahandoi, in Penampang
The court was informed by the prosecution that Faizul was arrested by police during a raid where the replica pistol was found in a clothing bag inside the vehicle.
Inspector Suzie @ Stephanie Kupit, prosecuting applied for an adequate sentence.
Counsel Luke Ressa Balang, representing Faizul, applied for a lower fine on the grounds that the pistol was never used and cannot be used as it was broken based on the police report.
Faizul was charged under Section 36(1) of the Arms Act 1960 which provides for a jail term of up to a year and fine of up to RM5,000 or both, on conviction.
In another case, a 23-year-old man was fined RM100 or a day’s jail for having a motorcycle believed to be stolen.
Shahril Aznie admitted to having the machine belonging to Azrol Fikri which he failed to account satisfactorily how he obtained it at 10.10am on June 15, this year at Tuaran.
He was charged under Section 22A(1) of the Minor Offences Ordinance which provides for a fine of up to RM100 or jail term of up to three months or both on conviction.
