Kota Kinabalu: A 47-year-old man, who was charged with drink-driving two years ago, was freed of the charge Thursday.

Magistrate Lovely Natasha Charles discharged and acquitted Dicky Lee of the charge without calling for his defence.

Lee was accused of committing the offence at 12.25am on Dec 12, 2020 at Jalan Bundusan, in Penampang.

The charge under Section 45A(1) of the Road Transport Act (Amended 2020), provides for a jail term of up to two years and fined between RM10,000 and RM30,000 and lost qualification from holding or getting a driving licence for not less than two years from the date of conviction.

The prosecution had called four witnesses to testify at the prosecution’s stage.

Lee was represented by counsels PJ Perira and Ariel Dasan.

Meanwhile, a 29-year-old man was jailed one day and fined RM10,000 or three months’ jail for committing a similar offence.

Azreyzan Maidin pleaded guilty before Magistrate Jessica Ombou Kakayun to committing the offence at 2.15am on May 28, this year at Jalan Kepayan here.

The court also ordered for Azreyzan to be disqualified from holding or obtaining a driving licence for two years from the date of the conviction.
