Kota Kinabalu: A 21-year-old woman was freed by the High Court from two counts of drug-related offences including drug trafficking.

Judge Leonard David Shim on Tuesday acquitted and discharged Tiong Wen Jing without her defence being called.

Leonard held that the prosecution had failed to establish a prima facie case.

The defence succeeded in raising reasonable doubt on the truth of prosecution’s case on both charges, held Leonard.

The charge under Section 39B (1)(a) of the Dangerous Drugs Act (DDA) 1952 carries a punishment with either the death penalty or life in prison and whipping with a minimum of 15 strokes, on conviction.

Tiong was also charged with having 3.47gm of Cannabis at the same place and time.

The charge under Section 6 of the DDA provides for a fine of up to RM20,000 or a jail term of up to five years or both, on conviction.

The trial commenced on Aug 7, this year.

The prosecution had called six witnesses to testify in the trial at the prosecution’s stage.

Tiong was defended by assigned counsel Zahir Shah.
