SANDAKAN: A 41-year-old man was on Monday freed from a charge of trafficking 702.6gm of cannabis three years ago.

High Court Judge Datuk Celestina Stuel Galid discharged and acquitted Huzaimie Ismail at the end of the prosecution without calling for his defence.

The court ruled that the prosecution has failed to establish a prima facie against Huzaimie.

Huzaimie was seen bowing in gratitude in the dock after hearing the decision.

Huzaimie was accused of committing the offence at 1.30pm on April 19, 2021, at the side of a building near a fresh market shop in Taman Mawar.

The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952 carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.

The prosecution was carried out by the Deputy Public Prosecutor Sofia S Sawayan.

Huzaimie was represented by counsel Hamida Ambo.
