Kota Kinabalu: Two Sarawakian brothers were tentatively charged, Wednesday, with four counts of drug trafficking.

Unemployed Chin Jin Kim, 23, and runner Chin Jin Yu, 30, who were brought before Court Registrar Rita Kunsoi, were accused of committing the offence at 7.40pm on Sept 26 at Block E of Phase 5, Beverly Hills, Penampang.

However, no plea was recorded from the brothers, who were from Miri, after the charges were read out to them.

The charges stated that the duo were jointly accused of trafficking 4,015gm of syabu, 2,150.55gm of Ketamine, 1,525gm of 3,4-Methylenedioxymethamphetamine (MDMA) and 330gm of Nimetazepam.

Each charge is framed under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes.

Prosecuting officer Inspector Suzie @ Stephanie Kupit applied for a new mention date while waiting for the chemist’s reports and objected to bail for the accused as the charges against them have no provision for one.

Rita fixed Nov 15 for mention and ordered the duo, who were not represented, to be remanded further.

In another case, a personal driver was charged with giving false statement to police.

Mohd Azril Yahyulalam, 33, was accused of committing the offence to ASP Andi Ma’mur Halwati at 10.30am on Feb 16 at the Criminal Investigation Office, Penampang Police Station.

No plea was taken from Azril who was charged under Section 182 of the Penal Code which carries a jail term of up to six months or a fine of up to RM2,000 or both, on conviction.

The court set Oct 16 for his appearance before a Magistrate and was offered bail at RM1,500 in two sureties.

In another development, an excavator operator was charged with trespassing into a store room.

Kenneth David, 36, allegedly sneaked into the store room occupied by Razpar Yasir, next to a washroom on the first floor of Centre Point Sabah Mall, at 10.30am on Oct 8.

No plea was taken from Kenneth after the charge under Section 448 of the Penal Code was read out to him.

The prosecution in applying for a mention date proposed bail at RM5,000.

Rita fixed Oct 18 for Kenneth’s plea to be taken at the Magistrate’s Court and released him on a bail of RM1,500 in two sureties.
