
Kota Kinabalu: Two men were fined RM1,600 or one month jail each on Wednesday for assaulting a man in Penampang recently.
Willie Warton, 23, and Md Eirfenddy Syam, 37, pleaded guilty separately before Magistrate Jessica Ombou Kakayun to hurting Kelvin Liew at 10pm on June 20, in front of the Chillout Café & Lounge, Kepayan Point, Penampang.
Inspector Albert Basiri prosecuting, told the court that Liew’s friend lodged a police report stating that on the said day, while he was drinking alcoholic beverages, Kelvin rushed to him to seek for help.
About 10 people then came and assaulted Liew and his friend, causing Liew to suffer severe injuries on his face and was sent to hospital for treatment, the court heard.
Police investigations revealed that the brawl was due to a misunderstanding between Liew and other customers of the premises during a drinking session.
Both Willie and Eirfenddy, who were unrepresented, requested for a lenient sentence by saying that they have been remanded for seven days and have dependants.
They were charged under Section 323 of the Penal Code which carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.
In another case, a 38-year-old man was fined RM2,000 or six months jail for assisting in hiding a stolen T-shirt.
Amirul Husni admitted to hiding the stolen item belonging to Metrojaya Suria Sabah at 3.50pm on April 11 this year in a house at Kg Lok Kurai, Pulau Gaya.
The offence under Section 414 of the Penal Code carries a jail term of up to seven years or fine or both, on conviction.
Unrepresented, Amirul requested for lenient sentence by saying that he has family members who depend on him.
