Kota Kinabalu: An e-hailing car driver, who stole a dashcam and a power bank from a shop to purchase diapers and formula milk for his toddler, was jailed two weeks.
Josua Jervy, 31, pleaded guilty before High Court Senior Assistant Registrar Don Stiwin Malanjum to committing the offence at a shop in Sinsuran, here, at 7.26pm on Nov 9.
The prosecution informed the court that Josua’s act was captured on CCTV where he was seen entering the shop and talking to the shop assistant before stealing the items.
The shop suffered loss of RM700, the court heard. Counsel Lim Ming Zoong @ Lawrence representing Josua, requested a bond of good behaviour or minimum fine on the grounds that Josua has no fixed income and works as an e-hailing car driver and is married with a one-year-old child.
Lim said Joshua stole the items as he wanted to resell them for money to purchase diapers and formula milk for his child as his income was not enough plus the prices of items nowadays were expensive and that his wife is not working.
Inspector Navind Kumar Vijayan applied for a deterrent sentence.
The court ordered Josua, who was on police bail from Nov 17, to serve the sentence from Thursday.
Joshua was charged under Section 380 of the Penal Code carries a jail term of up to 10 years and liability of a fine or whipping, on conviction.

They were charged under Section 45A(1) of the Road Transport (Amended) Act 2020, which provides for a jail term of up to two years and fined between RM10,000 and RM30,000 and lost qualification from holding or getting a driving licence for not less than two years from the date of conviction.
The court ordered their licence to be suspended for two years.
