Elderly man denies charges of raping granddaughter in Seremban

AN elderly man has pleaded not guilty at the Sessions Court in Seremban to three charges of raping his biological granddaughter, who was 10 years old at the time, between 2020 and 2021.

The 73-year-old accused, whose relationship with the victim is prohibited by law, religious decree, custom, and convention for marriage, entered his plea before Judge Datin Surita Budin after the charges were read.

The court set bail at RM90,000 for all charges with additional conditions, and disallowed the accused’s daughter, a witness in the case, from becoming the guarantor.

The charges state that the accused, whose identity was not revealed, committed the first offence between 22 June 2020 and 29 July 2020, from approximately 2.30pm to 3pm, at a shophouse in Putra Point, Bandar Baru Nilai.

The other two offences allegedly took place at a house in Taman Desa Cempaka, Nilai, between November 2020 and January 2021, from about 7pm to 10pm.

The offences are punishable under Section 376(3) of the Penal Code, which carries a penalty of not less than eight years and not more than 30 years in prison, and not less than 10 strokes of the cane upon conviction.

Deputy Public Prosecutor Norazihah Asmuni initially offered bail of RM50,000 for each charge, noting that the accused is the victim’s biological grandfather.

She informed the court that the victim is currently living with her mother in Seremban, while the accused resides in Perak.

When given the opportunity to appeal, the accused stated he had nothing to say but informed the court that his child would pay the bail.

Judge Surita Budin subsequently fixed bail at RM90,000 for all charges.

Additional conditions include the accused reporting to the nearest police station once a month, refraining from disturbing the victim and prosecution witnesses, and cooperating with the police if summoned.

The court, however, rejected the application for the accused’s daughter to be the guarantor because she is slated to be one of the witnesses called during the trial.

Mention of the case for the submission of documents and appointment of counsel is scheduled for 29 October. - September 26, 2025
