Kota Kinabalu: The Sessions Court set Sept 26 for mention of the case involving a company charged with failing to securely cover an elevator door opening which caused an accident.
Judge Noor Hafizah Mohd Salim set the date for TK Elevator Malaysia Sdn Bhd via e-review for the status of the representation letter.
The company, as a sub-contractor, is accused of failing to securely cover or fence the elevator door opening as to prevent risk of persons falling.
The offence allegedly took place at 11.36am on Jan 14 this year at elevator number 4 at the sixth floor of the Proposed 25-Storey Mixed Commercial Development (with Subsidiary titles to be applied for) at Jalan Tun Fuad Stephen, here.
The company was charged under Section 10 (e) Factories and Machinery Act 1967 and punishable under Section 51 (2) of the same Act which provides for a fine of up to RM50,000, or a jail term of up to one year, or both.
In another case, the court fixed Sept 23 this year for oral submission by a 33-year-old man charged with gang robbery.
The court set the date for Azif Hafizan Abdullah when the prosecution closed its case after calling five witnesses during the hearing.
The court also fixed Sept 21 this year for written submissions. Azif allegedly robber John Jason Joseph, 27, of his gold necklace worth RM700 at 11.25pm April 26, this year in Jalan Tugu, Kg Air, here.
He allegedly committed the offence together with Azmil Ahmad Hassan, 28, who admitted to the charge and was sentenced accordingly and also an accomplice still at large.
Deputy Public Prosecutor Dacia Jane Romanus conducted the prosecution while Azif was not represented.
