A FORMER TH Properties deputy general manager of construction was charged with abetting the alleged criminal breach of trust involving RM14,000 in penalty payments collected from a contractor for a Lembaga Tabung Haji (TH) commercial development project.
Tengku Kamarolhisham Tengku Kamaruddin, 55, pleaded not guilty after the charge was read before Sessions Court Judge Dazuki Ali.
He was accused of abetting Mohamad Hashim Mukhatap, 53, then construction manager of THP Timur Sdn Bhd, by causing RM14,000 collected as penalties from contractor Kelpile Sdn Bhd to be deposited into Mohamad Hashim’s bank account.
The offence was allegedly committed at Sofea Residensi, Section 12, here, between Nov 15, 2017 and Aug 8, 2018.
The charge relates to a proposed 22-storey commercial development comprising 244 serviced apartments, four penthouses, public facilities, commercial space, parking facilities, additional basement levels and related amenities on Lot 273, Section 12, Kota Bharu.
TH Properties is a subsidiary of TH, while THP Timur Sdn Bhd is a subsidiary of TH Properties.
Tengku Kamarolhisham was charged under Section 409 of the Penal Code, which carries a prison sentence of between two and 20 years, whipping and a fine upon conviction.
Malaysian Anti-Corruption Commission deputy public prosecutor Asmah Che Wan appeared for the prosecution, while lawyer Fahmi Abd Moin represented Tengku Kamarolhisham.
Fahmi sought bail of RM5,000, saying his client was self-employed with a monthly income of RM5,000 and had six children to support.
He also told the court that his client had diabetes and heart disease.
The court granted bail of RM8,000 with one surety and ordered Tengku Kamarolhisham to report monthly to the Shah Alam branch of the Malaysian Anti-Corruption Commission and not to interfere with witnesses.
The court fixed Oct 19 for mention of the case. - September 21, 2026
