In a shocking case that has sent shockwaves through the community, a father who committed unspeakable acts against his own daughters has been handed a severe punishment by the Sessions Court in Muar. The 53-year-old man, whose identity is being withheld to protect the victims, pleaded guilty to 19 charges of rape and 11 charges of sexual assault against his two daughters.
The court, presided over by Sessions Judge Abu Bakar Manat, sentenced the accused to an astounding 702 years in prison and 234 strokes of the rotan. However, due to legal considerations, the man will serve a 42-year prison sentence, as the judge ordered all the sentences for rape and sexual offenses to run concurrently from the date of his arrest on July 10.
The severity of the crimes committed by the accused is reflected in the charges brought against him. The first to 19th charges accuse him of raping his two daughters, who were aged nine and ten at the time, at two different locations in Bakri and Jalan Jeram Tepi between 2018 and July 9 of this year. These charges fall under Section 376 (3) of the Penal Code, which carries a maximum prison sentence of 30 years and 10 lashes per offense upon conviction.
Additionally, the accused faced the 21st to 30th charges, which accused him of sexually assaulting both victims at the same locations and timeframe. These charges were brought under Section 14 (a) of the Sexual Offences Against Children Act 2017, read together with Section 16(1) of the same Act. If found guilty, the accused could have faced imprisonment of up to 20 years and whipping.
During the sentencing, Deputy Public Prosecutor Danial Munir urged the court to impose a heavy sentence, emphasizing the gravity of the offense and the lifelong trauma inflicted upon the victims. The accused, who chose not to be represented by legal counsel, pleaded for a lighter sentence, claiming remorse and repentance for his actions.
In light of the evidence presented and the heinous nature of the crimes, the court handed down a sentence of 30 years in prison and 10 strokes for each count of rape. For the charges of physical sexual assault, the accused received a sentence of 10 years in prison and two strokes for each charge under Section 14. Additionally, he was sentenced to an additional two years in prison and two strokes for each charge under Section 16.
