KOTA KINABALU: A 21-year-old Filipino, already serving a sentence for illegal entry, was charged with three counts of raping an underaged girl in Tuaran.
No plea was recorded from Mohd Khairul Nizam after he told Sessions Court Judge Amir Shah Amir Hassan that he had a lawyer to represent him.
The charges, read in court on Wednesday, allege that the offences involving a 15-year-old girl took place at different locations in Tuaran between September and December last year.
The case was fixed for mention on Sept 4, with no bail offered as the accused is a foreign national, while the offence under Section 376 of the Penal Code carries a maximum 20-year jail term and whipping.
In a separate case, a 31-year-old woman, Nurizzah Fazira Hamzah, pleaded guilty to criminal breach of trust involving RM10,100 and will be sentenced on Sept 3, with the court ordering her further remand in the meantime.
