Kota Kinabalu: A 19-year-old Filipino was jailed five years and ordered to get two strokes of the cane for committing physical sexual harassment against his underaged girlfriend.

Sessions Court Judge Dayang Ellyn Narisa Abang Ahmad meted out the sentence during the sentencing of the offender who was 18 during the incident.

The Filipino had committed the offence against the 15-year-old girl by trying to have sex with her, kissing and making ‘love bites’ on her.

The offence took place at between 10am and 9pm on April 9, 2022 at an apartment in Taman Ketiau, Putatan.

Read more The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction.

The court ordered the Filipino to serve the jail sentence from the date of his first remand on April 10, 2022.

The Filipino was also ordered to undergo rehabilitative counselling during detention and places under police supervision for one year after completing the jail sentence.

On April 10 this year, the Filipino was ordered to enter his defence after the court ruled that the prosecution had established a prima facie case.

However, the Filipino had decided to changed his plea and admitted to the charge.

The prosecution had called five witnesses during the hearing.

Deputy Public Prosecutor Suriyati Jumain appeared for the prosecution while counsel Amli Nohin defended the man.
