In a recent ruling at the Tawau High Court, Nurhan Khalid, an unemployed Filipino man, received a severe sentence for the killing of two Indonesian men in Semporna two years ago. Judge Datuk Duncan Sikodol sentenced Nurhan, 31, to 80 years in jail and 24 strokes of the rotan after he pleaded guilty to the charges.

Nurhan was found guilty of murdering Hipang Iba Bernadus and Tomas Yohanes at a church in Ladang Pinang, Semporna, between 4 pm and 5 pm on June 26, 2022. The charges, under Section 302 of the Penal Code, carry the death penalty or imprisonment of not less than 30 years and not more than 40 years, along with not less than 12 strokes of the rotan.

Despite the severity of the sentence, Nurhan will only serve 40 years in prison as the court ordered his sentences to run concurrently from the date of his arrest on June 26, 2022.

In a separate case, another Filipino man, Isnawi Sarawi, 45, was sentenced to 30 years in jail and 12 strokes of the rotan for distributing drugs in Lahad Datu last year. Isnawi pleaded guilty to distributing 199.71 grammes of syabu in Jalan Kampung Panji and Jalan Pantai, Lahad Datu, at 3.30 pm on February 1 last year.

Isnawi was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries the death penalty or life imprisonment, along with not less than 15 strokes of the rotan if not sentenced to death. He was ordered to serve his sentence from the date of his arrest on February 1, 2023.

Deputy Public Prosecutor Hurman Hussain prosecuted both cases, while lawyers Jhassary P Kang, Jhesseny P Kang, and Vivian Thien appeared for the accused in their respective cases.

These cases highlight the seriousness with which the Malaysian judiciary treats crimes, particularly those involving violence and drugs. The sentences handed down serve as a deterrent to others who may contemplate committing similar offenses.

It is important to note that the courts considered the gravity of the crimes and the impact on the victims' families in delivering these sentences. The families of the victims may find some closure knowing that the perpetrators have been brought to justice.

The legal representation provided to the accused is also crucial in ensuring a fair trial. Lawyers play a vital role in upholding the rights of the accused and ensuring that they receive a fair hearing.

The cases of Nurhan Khalid and Isnawi Sarawi serve as reminders of the need for vigilance against crime and the importance of upholding the rule of law in society.

Furthermore, these cases highlight the collaborative efforts between law enforcement agencies and legal professionals in combating crime. The successful prosecution and sentencing of individuals involved in such serious offenses demonstrate the effectiveness of these efforts.

It is also important to address the underlying issues that may lead individuals to commit such crimes, such as poverty, lack of education, and social exclusion. By addressing these root causes, society can work towards preventing such crimes from occurring in the future.

Overall, the sentences handed down in these cases reflect the commitment of the Malaysian judicial system to uphold justice and ensure the safety and well-being of its citizens. It sends a strong message that such crimes will not be tolerated, and those who commit them will be held accountable for their actions.
