
Kota Kinabalu: A company was fined a total of RM5,000 by the Sessions Court, Monday, on two counts of selling unregistered products three months ago.
Teck Yen Sdn Bhd, represented by its director, pleaded guilty before Judge Noor Hafizah Mohd Salim to committing the offences at its premises at Lido Square, Taman Che Mei, Penampang, at 3.10pm on June 8.
The company on the first count was fined RM2,000 or 30 days jail for selling a unit of unregistered product to Adela Marie.
On the second count, the company was fined RM3,000 or 30 days for selling 23 units of unregistered products.
The company had violated Regulation 7(1)(a) of the Control of Drugs and Cosmetic Regulations 1984 and committed an offence under Regulation 30(1) of the same Regulation which is punishable under Section 12(1) of the Sale of Drugs Act 1952 which provides for a fine of up to RM50, 000 or jail term of up to three years or both, on conviction.
The director requested a lower fine.
Prosecuting Officer Abu Suffian A. Rahman from the Pharmacy Department applied for an adequate sentence as a lesson to the company and other parties to be more responsible and not commit similar offence.
Abu Suffian submitted that enforcement action was carried out against the company following complaints about unregistered products.
Meanwhile, in the Magistrate’s Court, a man was charged with assaulting his wife.
However, no plea was taken from Mohd Syazwan Syamsurizal after the charge was read out to him before Magistrate Lovely Natasha Charles.
General worker Syazwan, 24, was accused of committing the offence towards his 22-year-old wife at 3am on Nov 28 in a unit at PPR Seri Keramat, Putatan.
He was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.
The court set Jan 22, next year for mention of the case and released the accused on a bail of RM2,500 in two sureties with conditions to report to the investigating officer once in fortnight and not to approach his wife.
