In a recent court case in Malaysia, a Filipino man named Najmi Tangan, aged 24 was sentenced to 12 years in jail and five strokes of the rotan (a type of cane) for sexually assaulting an underage Filipina girl. The incident occurred on May 20th at an unnumbered house in Jalan Pintas, Penampang.

Najmi pleaded guilty to the offence under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a potential prison sentence of up to 20 years and caning. According to the facts presented in court, Najmi had met the victim's parents in May of this year and had falsely claimed to be a cousin of the girl's father from the Philippines. On the day of the incident, Najmi called the victim's mother and offered a job opportunity for her daughter.

He tricked the mother into providing the victim's phone number by stating that he knew about a job with a monthly salary of RM1,200. Najmi then called the victim, informing her that he had arranged an e-hailing car to take her to the Imago shopping mall. However, when the victim entered the car, the driver informed her that the destination was actually Plaza 333. At Plaza 333, Najmi met the victim and deceived her into going to an empty house. He sexually assaulted her and punched her, causing her to lose consciousness.

When the victim regained consciousness, she discovered that her phone and pocket money was missing. She sought help and reported the incident, leading to Najmi's arrest on May 27th. During the court proceedings, Deputy Public Prosecutor Dacia Jane Romanus presented the case against Najmi. In addition to the legal consequences, the court also ordered that Najmi be referred to the Immigration Department after serving his sentence.

This indicates that Najmi is an undocumented individual and unemployed. The involvement of the Immigration Department serves to address his immigration status as well as potentially prevent him from re-offending in the country.

This case serves as a reminder of the importance of protecting underage individuals from sexual assault and exploitation. The severity of the sentence reflects the gravity of the offence and aims to deter others from committing similar crimes. It also highlights the need for increased awareness and education to prevent such incidents from occurring in the future.
