Former police officer jailed after pleading guilty to drugging and raping woman

A former police officer who drugged and raped one woman and subjected another to years of abuse has been sentenced to seven years in prison.

Derek McNee, 42, from Glasgow, admitted to the series of offences which began in 2021.

The Crown Office said he admitted to repeatedly raping one victim after giving her drugs that rendered her unconscious. McNee’s criminality was uncovered when officers seized his mobile phone during an unrelated enquiry and discovered recorded videos showing him performing sex acts on the unconscious woman.

Sentencing him at the High Court in Glasgow on Monday, judge Lord Young told McNee that the victim had been "incapable of giving consent" due to her intoxicated condition.

The former officer also admitted to a five-year course of abusive behaviour towards a second woman, as well as possessing a hidden electronic stun gun – described as an "ultra-high voltage" device – found inside his car. McNee left Police Scotland in 2016 and subsequently ran a pet salon in Paisley, Renfrewshire.

Having pleaded guilty in September, McNee was sentenced on Monday to seven years in jail alongside an 18-month extended monitoring period. Judge Young also placed him on the sex offenders register indefinitely and made him subject to non-harassment orders.

In sentencing remarks published online, the judge told McNee: "This criminal behaviour came to light when the police seized your mobile phone in connection with other matters. Police found four of these videos on your phone. The acts that are shown in the videos and narrated in the charge amount to rape and to sexual assault."

Highlighting the victim impact statement from the woman McNee drugged and raped, the judge noted: "There can be no doubt that the complainer describes her misery at the time of these events. She has also described, very fully, severe psychological and practical consequences of these events. Some of these continue to affect her life to a significant extent to this day."

Regarding the second victim, he added: "She describes effects of your offending both in the past and ongoing to the present. These include: loss of self confidence, fear, anger and helplessness. She remains hypervigilant and anxious."

procurator fiscal Faye Cook, of the Crown Office of Procurator Fiscal Service (COPFS), said: "Derek McNee subjected two women to serious abuse and exploitation. He used drugs to facilitate the rape of one woman, rendering her incapable of consenting to sexual activity. He also subjected another woman to controlling, abusive and degrading behaviour.

"These offences had a profound impact on both victims, who should have been safe in his company. His conviction reflects the courage of the women who felt able to report their experiences, enabling prosecutors to seek justice on their behalf. COPFS is committed to listening and responding to such reports and holding perpetrators to account. Prosecuting offenders such as McNee helps make Scotland a safer place for all."
