General worker jailed 14 months for keeping stolen vehicle

Kota Kinabalu: A 24-year-old general worker was sentenced to 14 months, jail on Tuesday for keeping a stolen vehicle.

Ardie Ariansyah Abd Salam pleaded guilty before Magistrate Lovely Natasha Charles to having the Toyota Hilux belonging to one Mohd Azmir Nasir at 4.55 pm on March 19, this year at an open space near the telecommunication substation Suria Sabah, Jalan Tuaran Bypass, Inanam.

The charge under Section 411 of the Penal Code carries a jail term of between six months and five years and liability of a fine, on conviction.

The Magistrate was informed by the prosecution that the vehicle was reported stolen from Plaza YLY Kolombong on March 7 this year.

Ardie was arrested by police on March 19 at a restaurant in Inanam while he was dealing to sell the vehicle.

Ardie then led the police to the recovery of the stolen Hilux.

Duty counsel Carmen Khoo, representing Ardie, applied for a lenient sentence on the grounds that he was remorseful and that he was taking care of his parents.

The prosecution applied for an adequate sentence and for the vehicle to be returned to its rightful owner.

The court ordered Ardie to serve the sentence from the date of his arrest and ordered the vehicle to be returned to its owner.

In another case, a scrap metal collector was jailed two months for having tools without a lawful excuse.

Budiman Tanai, 41, admitted before Magistrate Jessica Ombou Kakayun to having a hacksaw and a steel cutter at 12.30pm on March 23 at a roadside of Jalan Tunku Abdul Rahman, near the UTC Sembulan.

He was charged under Section 18(e) of the Minor Offences Ordinance which carries a jail term of up to six months, on conviction.

Budiman told the court that he collected the items because he wanted to sell them.

Counsel Khoo, representing Budiman, applied for a lenient sentence and submitted that he was a divorcee with two children and was remorseful of his action.

Meanwhile, 12 people were penalised for committing drug-related offences.

Eight of them pleaded guilty to taking amphetamine and syabu while another four admitted to having syabu.

The eight Damasus Malik, Rasman Osman, Md Syazwan Dominic, Haziq Haikal, Md Asdi Lazim, Sulaiman Hamid, Jonaidi Junior and Affendi Rahman were arrested at separate locations here and in Penampang between Oct 20, 2022 and Jan 12 this year after they tested positive for the drugs, respectively.

Damasus was ordered to pay a RM2,000 fine or five months in jail while the rest were handed nine months’ jail each.

Taking drugs under Section 15(1) of the Dangerous Drug Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.

The other four were Lionel Ling, Suhaidi Johny, Rezki Alfahusi and Jimat Susanto who were charged under Section 12 (2) of the Dangerous Drug Act 1952 provides for a fine of up to RM100,000 or up to five years’ jail or both, on conviction.

Ling was fined RM4,500 or 15 months on the first count of having 1.94gm of syabu in a car at the roadside of Imago Mall here at 2.20pm on Jan 12 this year.

He was ordered to pay another fine of RM2,000 or 12 months’ jail on the second count of having 0.09gm of syabu in his bag in the said mall on the same day.

Suhaidi, Rezki and Jimat were each sentenced to 10 months’ jail from the date of their arrest. Inspectors Kelvan Elson Maik and Albert Basiri prosecuted.
