Guard charged with raping daughter

Kota Kinabalu: A security guard was charged with two counts of raping his daughter.

However, no plea was recorded from the 42-year-old man after the charges were read to him before Sessions Court Judge Elsie Primus.

His plea was not taken pending the chemist report and report from Child Interview Centre.

On the first count, the man is accused of raping the 16-year-old girl in a living room of a house in Kota Marudu on 1am on Sept 2 this year.

On the second count, he allegedly raped the same alleged victim at the same place at midnight on Sept 8.

The offence under Section 376(3) of the Penal Code provides for a jail term of between eight and 30 years, and whipping at least ten strokes, on conviction.

The court set Oct 27 for mention and no bail was offered to the man following the objection by the prosecution.

Earlier, Deputy Public Prosecutor Mas Izzaty Lokman objected to bail to the man on the grounds that the man and the alleged victim are staying in the same house and there was a high possibility he would tamper with the prosecution witnesses especially the alleged victim and his wife.

Mas Izzaty also submitted that the man had allegedly committed the rape twice in the same month.

The man, who was not represented, told the court that he had nothing to say.

Meanwhile, a 29-year-old man was freed from a charge of taking syabu for the third time.

Sessions Court Judge Marlina Brahim discharged and acquitted Azwan Tanjilul, after ruling that the prosecution failed to prove its case beyond reasonable doubt against Azwan.

Azwan was accused of taking the drug at 4.10pm on Oct 7, 2019 after his urine was tested positive for drug at the Keningau police station.

The charge stated that he has two previous conviction records for taking drugs.

Counsel Hairul Vaiyron defended Azwan.

Four prosecution and one defence witnesses were called during the hearing.
