Guard ordered to enter defence for raping girl, 9

Kota Kinabalu: A 62-year-old security guard who was charged with raping a nine-year-old girl last year was ordered to enter his defence.

Sessions Court Judge Amir Shah Amir Hassan made the order on Monday, ruling that the court was satisfied that the prosecution had proved a prima facie case against Liwoh Tigoan.

Liwoh was accused of raping the girl on the evening of May 3, 2022, at a house in Jalan Kionsom, Inanam new township, near here.

The offence under Section 376(2)(e) of the Penal Code carries a jail term of between 10 and 30 years, and whipping, on conviction.

The court set Nov 11 for Liwoh’s defence.

Six prosecution witnesses were called to testify during the prosecution stage.

Deputy Public Prosecutor (DPP) Dacia Jane Romanus prosecuted while Liwoh was represented by counsel Jaikol Situn.

Meanwhile, 12 people were penalised by the Magistrate’s Court for taking drugs.

Nicholas Joseph, Jerry Sameh, Alryan Larry, Welson Bilan, Dean Joe, Naan Dani, Haszarul Hekam, Abdullah Said, Mohd Nur Ibrahim, Jesman Ampon, Windly Ong and Ramlan Kalo pleaded guilty separately before Magistrate Stephanie Sherron Abbie to committing the offence at different locations here and in Penampang between May 20 and July 5.

Nicholas was jailed 16 months, Jerry was jailed 14 months, Alex was jailed 12 months, Welson was jailed nine months, Haszarul, Dean and Nan were given eight months jail each.

Abdullah, Mohd Nur and Jesman were jailed seven months, while Windly and Ramlan were fined RM2,000 or eight months jail each.

Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail, on conviction.
